A.R.S. 23-403.A.: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to his employees in that the employer failed to require the use of a restraint device and failed to equip a forklift with an operator restraint device (i.e., seat belt), to use while operating such trucks. Both the American National Standards Institute (ANSI) B56.1, consensus standard for powered industrial trucks and ASME B56.1-2000 - Safety Standard for Low Lift and High Lift Trucks, recognize the hazard of forklift tip over and the need for operators to use an operator restraint system, such as a seatbelt. a) 5340 West Luke Avenue, Phoenix, AZ 85301: The employer failed to require employee(s) who were operating forklifts to wear a seatbelt while operating the forklifts. One (1) yellow power industrial truck (i.e., forklift), model #MT80B, serial #78479, had been operated without the use of a seatbelt.
