P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of
1970: The employer
did not furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the hazard of falling from or being struck by
the bucket of an
excavator which was lifting them out of an excavation:
a) Lakeshore Subdivision Pump Station, under construction - Employees were
being lifted out
of a twelve foot deep excavation while holding onto a hook that was
attached to the bucket of
a Deere 230 LC excavator.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is
to provide an alternate means of access, such as a ladder, and not allow
riders on the excavator
or its attachments, as per the industry safety requirements listed in the
Construction Industry
Manufacturers Association (CIMA) Publication, "Safety Manual for Users,
Operators,
and
Maintenance Personnel, Hydraulic Excavator," which states, "Never allow
anyone to ride the
attachment or the load."ment
