P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard falling from a wooden pallet supported by a forklift: A) Production area - Employees were exposed to a fall of approximately 10 feet while working from a wooden pallet supported by a forklift, without conventional fall protection (standard guardrails, personal fall arrest, etc.). Among other methods, one feasible and acceptable means of abatement is to utilize a properly designed personnel platform that is equipped with standard guardrails in accordance with ASME B56.1b-2003.
