P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being thrown out of the operator's seat and being crushed by the powered industrial lift truck: a) Plantwide - The employer did not enforce the use of seatbelts for employees who operated the TCM Model FCG20T71 and the TCM FCG20N6T forklifts. Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure that employees wear a seatbelt while operating a powered industrial truck, as required by ANSI B56.1.ed
