P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard(s) of being struck by motor vehicles: a) Whitaker St. Eastbound, between Oglethorpe & York Streets - An employee working in a Temporary Traffic Control work zone without High Visible Apparel was exposed to being struck by moving vehicular traffic. One feasible and acceptable means of abatement is follow the guidelines in the Manual on Uniform Traffic Control Devices 2003 Edition; to ensure all workers are provided with reflective vests and have been instructed to use reflective vests while working within the rights of way on interstate highways, state, city, and any other public roadway; and implement an effective disciplinary program to ensure compliance.
