North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: fall and struck by hazards: a)jobsite, Mooresville, the employer failed to follow manufacturers recommendations by allowing employees to work from a work platform while raised by a New Holland LS 170 skid loader. The New Holland operators manual states that the skid loader is not a man-lift.
