Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to point of operation hazards:
a) The selection method between the two-hand operator's control(s) and the
foot control(s) on
the Guifil press brakes were not capable of being supervised.  The
machines were used during
the period between August 20, 2003 and February 20, 2004.
Among others, one feasible and acceptable method of abatement would be to
remove the
actuating control selector keys from the actuating control selector after
setup and control
selection.
In accordance with 29 CFR 1903.19(c), abatement certification is required
for this violation
(using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

were exposed to the hazard of moving parts of machinery:
a) The Wells horizontal band saw was not equipped with a magnetic restart
or similar device,
as prescribed by the American National Standards for Metal Cutting Saws,
ANSI B11.10-1990,
Section 5.2.3.4, that in the event of an interruption in the electrical
supply would prevent the
saw from restarting automatically when power is restored.  The machine was
use during the
period between August 20, 2003 and February 20, 2004.
Among others, one feasible and acceptable means of abatement would be to
provide a magnetic
restarter or similar device as required by ANSI B11.10-1990.
Newko Tool and Engineering, Inc., was previously cited for a violation of
this
occupational
safety and health standard or its equivalent standard which was contained
in OSHA inspection
number 122492135, citation number 1, item number 1, issued on February 26,
2001, and
became a final order on or about March 21, 2001.
In accordance with 29 CFR 1903.19(c), abatement certification is required
for this violation
(using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
