recognized hazards which may cause death or serious physical harm to his
employees and comply with this regulation and other occupational safety and
health rules and regulations promulgated under Chapter 15 of Title 41,

Laws, State of South Carolina, 1976, as amended, as follows:
A.  Employer knew or should have known that employees using the Clark
forklifts Nos. 1, 2 and 3, were exposed to the hazard of being thrown from
and
crushed due to no seatbelt being provided.  A useful and feasible means of
abatement would be to install seatbelts on the Clark forklifts Nos. 1, 2,
and
3, located in the shop area of establishment.
