North Carolina General Statute 95-129(1) of the Occupational
Safety and Health Act of North Carolina:  The employer did not
furnish to each of his employees conditions of employment and a
place of employment which were free from recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees were exposed to:
a)12 foot in height falls to the dirt/debris below
working from a platform attached to a Sunbelt,
model#SS-644C, ID#S91070, located at E. Hanes Mill
Blvd., Winston Salem, NC, the employer did not ensure
that employees used their personal fall protection or a
fall arrest system to ensure that employees would not
be exposed to fall hazards.
or in the alternative:
29 CFR 1926.501(b)(1): Employees on a walking/working surface
with an unprotected side or edge which was six feet or more above
a lower level were not protected from falling by the use of a
guardrail system, safety net system or personal fall arrest
system.
a)jobsite, west side of building - employees were working
from a platform attached to a Sunbelt, model#SS-644C,
ID#S91070, exposing themselves to 12 foot in height
falls to the dirt/debris below without any personal
fall protection or fall arrest system.
One feasible and acceptable abatement method(s) to correct
this hazard would include ensuring that employees use their
personal protective equipment provided or a fall arrest
system.d
