North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)being struck by or caught between the #3 Weaver single pole vehicle lift (Serial# NA, Model# NA) and the concrete floor in the event the hydraulic lift failed, employees were operating a Weaver hydraulic lift with a defective lift control mechanism (potential sudden drops), lift being modified without the manufacturer's written permission, and lack of inspection procedures on September 9, 2004. Among other methods, one feasible and acceptable abatement method to correct this hazard is to follow the procedures outlined in the American National Standard Institute (ANSI), Automotive Lift Institute (ALI).
