Health Act of North Carolina: The employer did
not furnish each of his employees conditions of employment and a place of
employment free from recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees were exposed to:
a)a fall from a height of over 18 feet, employees were lifted to the top
of building under construction, the
employees were observed standing on a wooden pallet that was not attached
to the forks of a 506C
Loadall forklift (serial #587036).
Among other methods, one feasible and acceptable abatement method would be
to properly train
employees in fall protection and ladder usage. The employees had no fall
protection equipment while on
the forklift pallet platform nor was it necessary to work from the
forklift pallet platform.
