North Carolina General Statue 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)a potential of being crushed by the overhead monorail system in the event of its failure to support the three hoists used for lifting, was not inspected by a designated person to assure proper working order. Among other methods, one feasible and acceptable abatement method to correct this hazard was to have a designated person inspect the monorail system for proper working and installation order, not limited to but to include an operational test of the system, load test with proper rated load markings on the hoist and monorail visible from the ground and complete inspections of the monorail system shall be repeated thereafter as required. (Reference: ANSI B3011-2.1.1, Prior to initial use, all new, altered, modified, or extensively repaired cranes and monorails shall be inspected by a designated person to assure compliance with the applicable.)
