Section 6(a) of the Puerto Rico Occupational Safety and Health Act:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or physical harm to employees in
that employees were
exposed to die to the being struck by the equipment, turned upside down
and lose control.  The
trajectory through where the  employee drives the finguerlifts had an edge
that had a depth of
seven inches.  An employee drived a fingerlift trademark Clark, model CGP
25 Type D and
Serial Number P365D05239499FB by the described area:
Seccion 6(a) de la Ley de Seguridad y Salud en el Trabajo de Puerto Rico:
El patrono no
proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten
causando o que
puedan causar muerte o dano fisico a los empleados, por cuanto empleados
estaban expuestos
a fracturas y muerte al ser golpeados por equipo, volcarse o perder el
control.  La trayectoria
por donde los empleados conducen los montacargas tiene un borde con una
profundidad de siete
pulgadas.  Un empleado condujo un montacargas  marca Clark, modelo CGP 25
Tipo D Numero
de serie P365D05239499FB por el area descrita:
One feasible and abatement method  among others to correct the hazards can
be:
1)Place a railing  in the places where there are edges that can affect
the stability of the equipment.
2)Fix the conditions of the transit areas in such a way that they are
surfaces of first class according to is described in the ANSI B56.1
- 1969, Part III, section 5.
Un metodo viable entre otros metodos que se pueden utilizar para corregir
los riesgos existentes
es:
1)Colocar barandas en los lugares donde haya bordes que puedan
afectar la estabilidad del equipo.
2)Arreglar las condiciones de las areas de transito de tal manera que
sean unas superficies de primera clase segun descrito en el ANSI
B56.1 - 1969, Parte III, seccion 5.ccion
