Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: At the construction site located at 6700 Heritage Parkway, Rockwall, Texas 75087. On or about May 6, 2004, employees were working from an elevated platform laid across the forks of a Gradall Arm Forklift without the use of a guardrail system or personal fall arrest system, exposed to fall hazards.
