Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: a) On or about May 19, 2004, and times prior thereto, employees working throughout State Farm Records Center were exposed to the hazard of being crushed by collapsing and/or falling storage rack. The employer did not develop and implement the means to maintain the structural integrity of storage racks. Some feasible abatement methods include but are not limited to the following: 1.Develop and implement an inspection and planned maintenance program to ensure the structural integrity of storage racks is maintained, as recommended by Rack Manufacturers Institute. 2.Make timely repairs to damaged support rails in accordance with manufacturer's recomendations. 3.Develop and implement the means by which employees immediately report damage to racks. OR IN THE ALTERNATIVE 29 CFR 1910.176(b): Storage of material created a hazard (e.g., by sliding or collapsing): a) On or about May 19, 2004, and times prior thereto, employees working throughout State Farm Records Center were exposed to the hazard of being crushed by collapsing and/or falling storage rack. The employer did not develop and implement the means to maintain the structural integrity of storage racks.
