Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: At the front of the American National Bank new construction site located at: 5430 Hwy 78, Sachse, Texas 75048. On or about September 24, 2004, an employee working from an elevated platform of stacked 3/4-inch plywood sheets laying across the forks of a Sky-Trak 6036 Rough Terrain Forklift without the use of a guardrail system or personal fall arrest system was exposed to a fall hazard of approximately 22-feet.
