Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: Being struck by overhead structure of Fork truck if the truck overturned or have a Forklift tip over: On or about November 05, 2004, at establishment (knock out/cut off area), an employee was observed operating a forklift without using the seat belt installed by the manufacturer, exposing employee to the hazard of being struck by the overhead structure of the forklift in the event of a tip over. Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure that all forklift operators are required to wear seat belts while operating forklifts.
