Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazard of being struck by moving motor vehicles while
conducting pre-
departure truck cargo verification inspections:
a.On or about December 20, 2004, at the Autozone Distribution Center
security
gate's departing truck lane, an employee was exposed to motor vehicle
traffic
during a pre-departure inspection of a cargo trailer.  Adequate separation
was not
maintained between the cargo truck being inspected and the truck waiting to
advance to the position for pre-departure inspection in accordance with the
Manual on Uniform Traffic Control Devices(MUTCD) Part 6D-2  -  Worker
Safety Considerations.
Among other methods, feasible and acceptable abatement methods to correct
this hazard are to:
1.  Prohibit employees from crossing or working in front of any
potentially moving motor
vehicles.
2.  Periodically inspect the workplace to evaluate employee compliance
with
lane crossing/work
rules, with particular emphasis on achieving eye contact and proper
communication before
proceeding, and the implementation of effective progressive disciplinary
action to correct
deficiencies.
3.  Ensure employees wear traffic safety vests while working on or near
motor vehicle traffic
lanes in accordance with the MUTCD Part 6D-2 B.
