employer did not
furnish employment and a place of employment which was free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the hazard of being struck by a moving motorized
vehicle:
a.On or about January 3, 2005, Matrials Recovery Facility (Dumping Line
Area), an employee was struck and pinned by a moving New Holland Lx565
skid steer while it was being backed up.  Adequate separation was not
maintained between the skid steer and a stationary cargo truck.
Among other methods, feasible and acceptable abatement methods to correct
this hazard are
to;
1.  Designate a safe area for cargo truck operators to wait in their
trucks before preparing
their trucks for discarding cargo-bin contents.
2.  Prior to permitting an employee to operate a powered industrial truck,
ensure that each
operator has successfully completed training consisting of a combination
of formal instruction
(e.g., lecture, discussion, interactive computer learning, video tape,
written material),
practical training (demonstrations performed by the trainer and practical
exercises performed
by the trainee), and evaluation of the operator's performance in the
workplace.  All operator
training and evaluation should be conducted by persons who have the
knowledge, training,
and experience to train powered industrial truck operators and evaluate
their competence.
3.  Provide Operation & Maintenance Manuals to employees required to
operate, inspect,
and maintain skid-steers and similar equipment.
4.  Remove from service, any power-operated industrial truck not in safe
operating
condition.  Ensure all repairs are made by authorized personnel.
5.  Equip all bi-directional machines, such as front-end loaders and
similar equipment, with a
horn distinguishable from the surrounding noise level, to be operated as
needed when the
machine is moving in either direction. The horn should be maintained in an
operative
condition.
6.  Do not permit equipment which has an obstructed view to the rear to be
used in reverse
unless the equipment has a reverse signal alarm distinguishable from the
surrounding noise
level or an employee signals that it is safe to do so.
7.  Do not allow skid steers and similar equipment to be driven up to
anyone
standing in
front of a bench or other fixed object.
