Section 5(a)(1) Of The Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: On or about January 11, 2005, at the intersection of SH-66 and Scenic Drive, at Rockwall, TX, three laborers were cleaning water and dirt from the one of the west bound lanes of SH- 66 without the protection of channelizing devices (warning cones),to close the lane where laborers were working. The laborers were exposed to the recognized hazard of being struck by passing traffic.
