Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: On or about January 12, 2005, due to the lack of channelizing devices in the termination area of the work zone, employees, who were working in the North bound lane of the 1200 Block of Pleasant Drive were exposed to the hazard of being struck-by a motor vehicle.y
