Section 5(a)(1) of the Occupational Health and Safety Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: On the roof of the S/W corner of the Resource Building Materials building located at: 106 Regal Row, Dallas, Texas 75247. On or about January 27, 2005, at least two employees were exposed to the hazards of falling approximately 15-feet when using a personnel basket lifted by a Caterpillar TC60D forklift as a means to descend from the work area of the roof. Among other feasible methods to control the hazard: 1. Use an extension ladder to access the roof. 2. Comply with ANSI B56.1-1969 paragraph 603(L), Operating Safety Rules and Practices; Lifting personnel. 3. ASME B56.6-1992 paragraph 8.25 safety standards; Platforms for lifting personnel.
