Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which was free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the hazard of being struck by a moving motorized
vehicle:
a.On or about March 26, 2005, at the dock of 5829 Industrial Rd, an
employee
was exposed to the hazard of being struck by a truck/trailer.  The means to
maintain adequate separation between vehicles and pedestrians was not
implemented.
Feasible and acceptable abatement means of abatement include,
but are not limited to, the following:
1. Survey dock locations where drivers routinely
report to determine the predominant traffic
patterns for each facility.  Inquire at each facility
as to the existence of any traffic control plans
already in place and adhere to existing traffic
control plan.
2. Develop protocols/procedures for drivers to use
at sites without traffic control plans.  These
procedures may include direction for safe walking
paths, recognition of high congestion/low
visibility areas to avoid when walking and other
protective measures.  A reference for traffic
control plans/procedures  may be found in the
Manual on Uniform Traffic Control Devices.
3. Provide and require the use of high visibility
vests for drivers required to walk through
terminals with high traffic volume and/or
congestion that precludes the use of safe walking
zones.
