Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: On the west side of the newly constructed residential home located at 4712 Altessa in Plano, Texas 75093. On or about August 24, 2005 at least one employee, installing joists on the top of a pergola, was exposed to possible impalement hazards from the wrought iron fence. The employee was working approximately 12-feet 9-inches above the ground level. Among other methods, one feasible abatement method includes: 1.Install protective caps on all protruding points of the wrought iron fence.
