Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck-by or crushed: On or about 12/13/2005, the employer did not ensure that employees operating forklift were utilizing personal restraining devices such as seat belts. Forklifts are operated throughout the warehouse and in the packaging department. Among other possible methods, one feasible means of abatement for this hazard is the use of seat belts as outlined in ASME/ANSI B56.1 standard for powered industrial trucks.
