Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazard of moving parts of machinery:
a) One Grub vertical band saw and Four Haberele cut-off saws were not
equipped with a
magnetic restart or similar devices, as prescribed by the American
National Standards for Metal
Cutting Saws, ANSI B11.10-1990, Section 5.2.3.4, that in the event of an
interruption in the
electrical supply would prevent the saws from restarting automatically
when power is restored.
The machines were used during the period between September 16, 2003 and
March 16, 2004.
Among others, one feasible and acceptable means of abatement would be to
provide a magnetic
restarter or similar device as required by ANSI B11.10-1990.
In accordance with 29 CFR 1903.19(c), abatement certification is required
for this violation
(using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
