Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)Main Production Area-On or about 03/30/04 the Proecam Press Brake was not equipped with a guard to cover the foot control which actuates the press, as prescribed by the American National Standards Institute (ANSI) B11.3-2002, Section 6.10.4, that when provided, foot controls shall be protected to prevent unintended actuation. b)Main production Area-On or about 03/30/04 the Niagrara Shear was not equipped with a guard to cover the foot control which actuates the shear, as prescribed by the American National Standards Institute (ANSI) B11.4-1993, Section 5.2.2.5.5, that when provided, foot controls shall be protected to prevent unintended actuation. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), andin addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
