Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards: (a)McKinley Service and Equipment Company (Steelhead Platform): On or about December 12, 2007 an employee-in-training was exposed to and injured after being struck-by a 29' riser, when the load suddenly shifted due to slings too short for the type of lift, no lifting procedure addressing off-centered loads in place, inadequate communication between the lead rigger and rigger-in-training, pulling of the load (side-loading) across the deck causing the rope and ball to get wedged under the hatch lip and no hazard identification training for off-center load lifting. One feasible means of abatement in accordance with the Recommended Practice Practice for Operation and Maintenance of Offshore Cranes API RP 2D 1995 would be to develop and implement a JHA for addressing all known and potential hazards when lifting off-center loads, utilizing adequate slings appropriate for the particular lift configuration, provide and use adequate communication methods, provide a safe means to move equipment directly beneath the hook before attachment to the hook and provided hazard identification training by experienced personnel for all employees prior to making an off-center lift. Abatement certification and documentation required for this item.

One feasible means of abatement, among others, in accordance with the Recommended Practice for Operation and Maintenance of Offshore Cranes API RP 2D 1995 is to provide information for all employees concerning hazards associated with off-centered lifts. Abatement certification required for this item.
