Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to overhead and crush hazards: M/V Snopac Innovator, Case-up Area, 3rd deck hatch to fiber storage area: On or about June 18, 2008 and times prior thereto, employees were exposed to over head hazards from the improper use of the Jet L90 1 ton chain hoist that was used to elevate and support a one ton hatch in that: (a)Hoist was operated with missing latches on the top and bottom hook assemblies; (b) Chain hoist was operated with a side-loading of the hoist; and, (c) Hoist was left suspended unattended with no specific precautions in place. Among other methods, one feasible means of abatement would be to follow the owners manual and ANSI B30.16, "Overhead Hoists (Underhung)," for proper operations.,"
