Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to:
(a)Magone Marine Service Inc (Magellan barge): On or about February 4,
2010, employees
were exposed to electrical shock and arc blast hazards caused by an
electrical panel
which was not deadfronted and had three unprotected openings exposing an
energized
busbar which measured 11" x 2 1/2", 9"x 2 1/2" and 1"x 2 1/2" accessed by
unqualified
employees daily while the generator was feeding power to the panel.
(b)Magone Marine Service Inc (Magellan barge Main Compartment): On or
about February
4, 2010, employees were exposed to an electrocution and burn hazard caused
by missing
disconnects on the 220/120V main electrical panel fed from a generator
measuring
openings to the energized busbar of 11"x 2 1/2", 9"x 2 1/2" and 1"x 2 1/2"
within a half
and inch from where employees accessed the disconnects for use.
(c)Magone Marine Service Inc (Magellan barge mechanics office battery
charging area): On
or about February 4, 2010, employees were exposed to an electrical shock
and explosion
hazard caused by an energized receptacle which had an unused 3/4" opening
on the top
and an unused 1" opening on the right side of the box housing.
(d)Magone Marine Service Inc (Magellan barge Main Compartment): On or
about February
4, 2010, employees were exposed to an electrical shock hazard caused by an
unused 1/2"
opening in the right side of the Acme Electric Company transformer box
which stepped
the 240V incoming power from the generator to 120V for feeding the panel
used by
employees.
One feasible means of abatement among other methods would be to:
Inspect and repair all damaged electrical panels, boxes and devices on a
regular basis to avoid
accidental shock exposures for employees.
