Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Plant #2, Marine Terminal: On or about July 27, 2010 and at times prior thereto, the employer did not enforce the use of seat belts when operating a TCM Model# FHG16T0L, Serial# A44R00411 forklift truck. This condition exposed the employee to struck-by hazards and resulted in a multiple day hospitalization and extensive facial surgery. Among other methods, one feasible and acceptable abatement method to correct the hazard would be to follow the forklift truck manufacturer "Operator's Handbook" and ensure employees utilize the seatbelts provided.
