Minn. Stat. 182.653 subd. 2: The employer did not furnish to each employee, conditions of employment and a place of employment free from recognized hazards which caused or were likely to cause death or serious injury to employees: Two subcontractor employees were observed working from the basket of a rough-terrain forklift approximately 15 to 20 feet above grade without the use of a personal fall arrest system or a fall restraint system. Additionally, the basket was not secured to the forks or mast and the basket extended more than 10 inches past the outside of the forklift's wheelbase.
