Stat. 182.653 subd. 2: The employer did not furnish to each employee, conditions of employment and a place of employment free from recognized hazards which caused or were likely to cause death or serious injury to employees: A)The employer did not require employees to use available guardrail system components on the elevated platform personnel basket. B)The employer did not require the employee working from the personnel platform attached to an extendable-boom forklift to wear a personal fall arrest system. C)The employee did not have training sufficient to comply with the minimum requirements for working with this type of equipment and/or machinery. The employee replacing trim boards while standing on an elevated platform of a personnel basket attached to a Pettibone B-066, serial #5-982, unit #340015, was not required to use available guardrail system components. Furthermore, the employee was not required to wear a personal fall arrest system while working from the platform. Additionally, the employee did not present knowledge of safe work practices in regard to the equipment and/or machinery being used to comply with the minimum requirements of the standard.nts
