Minn. Stat. 182.653 subd. 2:  The employer did not furnish to each
employee, conditions of
employment and a place of employment free from recognized hazards which
caused or were
likely to cause death or serious injury to employees:
The employer failed to ensure that the employee, who had never assembled
this piece of
equipment prior to the incident, was implementing adequate safety
procedures, using
additional bracing, and had adequate training to prevent overturning of
the
equipment that
resulted in a crushing injury.g
