For purposes of settlement with the employer in the Informal Conference
stage, the
following Section 5(a)(1) violation will be deleted and replaced with 29
CFR
1910.134(d)(1)(iii).  See modifications at the end of this 5(a)(1) item:
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish to each of his employees employment and a place of employment
which were free
from recognized hazards that were causing or likely to cause death or
serious physical harm
to employees in that employees were exposed the solvent methyl ethyl
ketoxime while spray
painting window frames.  The recommended exposure limit for this substance
ranges from
0.5 ppm to 10 ppm.  MEKO is known to cause degenerative effects on the
olfactory
epithelium of the nasal passages.
(a) Accent Windows, Inc., 12300 Pecos Street, Westminster, CO  80234:
Feasible administrative or engineering controls were not determined and
implemented to maintain the spray painter's exposure to methyl ethyl
ketoxime
below the manufacturer's recommended exposure limit of 3 ppm. On April 21,
2004, the spray painter was monitored to determine their exposure to methyl
ethyl ketoxime while painting window frames. The painter was exposed to an
8-hour Time Weighted Average of methyl ethyl ketoxime of 11 ppm.  The
manufacturer's reaccommodate exposure limit is 3 ppm for an 8-hour Time
Weighted Average. The exhaust fan for the spray paint booth was undersized
and could not produce enough airflow through the paint booth to maintain
the
spray painter's exposure below the manufacture's recommended exposure
limit.  The employee was not wearing the appropriate respiratory
protection at
the time that the survey was conducted.
Feasible Abatement: The installation of a larger capacity exhaust fan will
increase the airflow through the paint booth resulting in lowering the
painter's
exposure to MEKO.
STEP 1:Effective respiratory protection shall be provided
and used by exposed employees as an interim
protective measure until feasible engineering
and/or administrative controls can be implemented
or whenever such controls fail to reduce employee
exposure to within exposure limits.
STEP 1 ABATEMENT DATE (15 DAYS): July 31, 2004
STEP 2:Submit to the Area Director a written detailed
plan of abatement outlining a schedule for the
implementation of engineering and/or
administrative measures to control employee
exposures to the hazardous substance referenced
in this citation.  The plan shall include, at a
minimum, target dates for the following actionswhich should be consistent
with the dates required
by this citation:
(a) Evaluation of the extent and location of the hazard source
(b) Evaluation of control measure options
(c) Selection of optimum control measures
(d) Determination of control measure design
(e) Ordering and delivery of equipment
(f) Installation of control measures
(g) Training of employees in proper operation and maintenance
of newly implemented control measures
(h) Assurance of the effective performance of control measures
All proposed control measures shall be evaluated for each particular use
by a competent Industrial Hygienist or other technically qualified
person.  Thirty (30) day progress reports are required during the
abatement period.  The progress report must identify the action taken to
achieve abatement and the date the action was taken.
STEP 2 ABATEMENT DATE (30 DAYS):  August 15, 2004
STEP 3:Abatement will be completed by the
implementation of feasible engineering and/or
administrative controls and upon verification of
their effectiveness in achieving compliance.

originally cited and issued on 07/13/2004:
29 CFR 1910.134(d)(1)(iii): The respiratory hazard(s) in the workplace
were not identified
and evaluated; to include a reasonable estimate of employee exposure to
respiratory hazard(s)
and an identification of the contaminant's chemical state and form:
(a) Accent Windows, Inc., 12300 Pecos Street, Westminster, CO  80234:
An employee, Spray Painter, who was spraying Benjamin Moore & Co.
"Ironclad Alkyd Low Lustre Metal & Wood Enamel" paint, Product No. 163,
n163, was exposed to an airborne concentration of at least 10.8 ppm of
Methyl
Ethyl Ketoxime, during the employee's work shift on April 21, 2004, and the
employer had not evaluated this respiratory hazard through the use of
personal
air monitoring.  Additionally, feasible administrative or engineering
controls
were not determined and implemented to maintain the spray painter's
exposure
to methyl ethyl ketoxime below the manufacturer's recommended exposure
limit of 3 ppm. On April 21, 2004, the spray painter was monitored by OSHA
to determine the employee's exposure to methyl ethyl ketoxime while
painting
