Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed burns from heated asphalt oil:
(a)Coulson Excavating at 2165 14th Street Southeast, Loveland, CO 80537:
The employer did not ensure the equipment had been properly and thoroughly
inspected in that the 3/8 inch valve and hot oil asphalt line had not been
thoroughly inspected or tested in at least two years.  This hazard exposed
the
employees to burns from hot asphalt oil.
Among other methods, one feasible and acceptable abatement method to
correct this hazard
is to maintain and inspect equipment per ANSO A10.27-1998, Safety
Requirements for Hot
Asphalt Facilities - American National Standard for Construction and
Demolition Operations,
paragraphs 4.23.1.7 and 4.23.17.2.  A recommended course of action is:
(1)Develop and implement an equipment testing program.
(2)Develop a written maintenance and operation program for all equipment
involved in the production process.
(3)Train maintenance employees in this program.
