Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of fire and explosion due to the release and ignition of gasoline: a)Loaf "N Jug/Mini Mart Company & 201 Main Street, Frisco, CO: On or before August 5, 2004, the employer did not ensure that employees performing maintenance on fuel dispensing devices were protected from the hazards of the release of fuel from the fuel dispensing system, and the hazard of ignition sources being present in areas where servicing of fuel systems was being performed. Vehicles were allowed in the fuel dispensing area during maintenance of the dispensing system. Employees performing maintenance on fuel dispensing devices did not posess the requisite knowledge to safely perform maintenance on such systems. Among other methods, one feasible and acceptable method to correct the hazard is to conform with the requirements of 2003 National Fire Protection Association 30A, Chapter 6, Paragraphs 6.3.6 (1) and 6.3.6 (4).
