Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish a place of employment which was free from recognized hazards that
were causing or
likely to cause death or serious physical harm to employees in that
employees were exposed
to fall, struck by, and caught between hazards:
a)G.H. Daniels & Associates & 27824 Highway 6, Wolcott, CO: On or before
April 27, 2005, the employer did not ensure that employees working at
heights
to remove twine from the tops of trees were provided with the safe
equipment/practices to accomplish such work.  An employee was
standing/riding in the front bucket attachment of a Bobcat skid-steer at
heights
up to 8 feet during this operation which exposed the worker to falling
from the
elevated bucket, being struck by the bucket, and being caught between
moving
parts of the Bobcat.
Abatement Note: Abatement certification is required for this item (see
enclosed "Sample
Abatement Certification Letter").
Among other methods, one feasible and acceptable abatement method can be
found in SAE
J153, Surface Vehicle Recommended Practice, Section 4.3 Operator-General
Precautions,
instructs operators: "Do not permit riders on the machine if there are no
manufacturer's
designated place for the rider." In addition, Section 7.10, Operating,
Precautions, instructs
operators to never allow anyone to be under or within reach while the
equipment is
operating.
