Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: a) NYS Rt 22 Canaan, NY The Flame Diner- on or about March 10,2004- employee was severly burned when a Pitco Frialator model 14 sn# 859y62498cn tipped over. Methods to prevent this hazard include: 1) Installing Pitco Frialator according to manufacture specifications and safety warnings to prevent from tipping over. 2) Install restraining device as according to manufacturers specifications so that Frialator is not knocked off of supports. 3) Install kitchen fryer on a level firm foundation as according to National Fuel Gas Code 54-44 6.11.6. NFC 1988 4) Maintain floors free of grease so that employees do not slip and contact hot frialator. 5) Train employees according to manufacture's operating manual prior to operating. ABATEMENT CERTIFICATION IS REQUIRED FOR THIS CITATION
