Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that:
a)   On or about 5/13/04 employees engaged in tree trimming operations
were exposed
to struck-by motor vehicle hazards while clearing limbs and branches in
the roadway and
directing vehicular traffic with flaggers.  Flaggers were not equipped
with signaling devices.
Among other feasible and acceptable methods to correct this hazard is to
equip
employees with flags or Stop/Slow paddles.  These abatement methods are
discussed in the
Manual on Uniform Traffic Control Devices (MUTCD) Millennium Edition
Section 6E.03.
b)  The flaggers directing motor vehicle traffic were not wearing
appropriate
clothing
exposing them to struck-by motor vehicle hazards.
Among other feasible and acceptable methods to correct this hazard is to
equip
employees with orange, yellow, yellow-green, or a fluorescent version of
these colors vest, shirt
or jacket.  These abatement methods are discussed in the Manual on Uniform
Traffic Control
Devices (MUTCD) Millennium Edition Section 6E.02.
c)  Employees and Flaggers were exposed to struck-by motor vehicle hazards
while
working in the roadway and directing traffic with no warning signs or
temporary work zone
signs posted.
Among other feasible and acceptable methods to correct this hazard is to
post signs
for flagging stations and warning signs for work zone.  These abatement
methods are discussed
in the Manual on Uniform Traffic Control Devices (MUTCD) Millennium
Edition Sections
6E.05 and 6H.01.
d)  Employees flagging motor vehicle traffic were not qualified and
trained exposing
them to struck-by hazards.
Among other feasible and acceptable methods to correct this hazard is to
ensure
employees are trained and qualified to be flaggers.  These abatement
methods are discussed in
the Manual on Uniform Traffic Control Devices (MUTCD) Millennium Edition
Section 6E.01.
