Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fire and explosion hazard from the improper storage of concentrated acid and a flammable solvent. Or in the alternative, 29 CFR 1910.176(c): Storage areas were not kept free from accumulation of materials that constitute hazards from tripping, fire, explosion or pest harborage. (a) On or about 09/02/04, Schenectady International, Inc., Rotterdam Junction facility, Quality Control (QC) laboratory's Retain Room, QC laboratory employees stored concentrated sulfuric acid and a flammable solvent, hexane, in the same flammable storage cabinet. Feasible means of abatement include, but is not limited to, the use of a dedicated and isolated storage cabinet for acids. ABATEMENT CERTIFICATION IS REQUIRED FOR THIS ITEM.
