Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: a)22 Schiavone Rd, New Windsor, NY - on or about June 7, 2005 - employees were exposed to a struck by hazard while engaged in the placement of concrete for a basement slab through a concrete pump. Employees were working adjacent to the end of the concrete pump hose while the pump was started and restarted. This is a violation of the Concrete Pump Manufacturers Association procedures for safe operation, Safety Standard for Concrete Pumps, Placing Booms and Delivery Systems, Section 27- 1.18.2.2. Methods to correct this hazard include, but are not limited to: 1) Develop and implement
