North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)3721 Tryon Road, Raleigh, NC - where an employee was exposed to a fall hazard during the application of striping to the side of the roof of a gas station while standing on the top of a metal eight foot Werner stepladder. The ladder was clearly marked with the warning "Do Not Stand at or above this level. YOU CAN LOSE YOUR BALANCE" on the step below the top of the ladder.
