North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to falling loads of up to 400 pounds (Reference: ASME B30.10-1999, Hooks): a)assembly area: two employees used a hook - SWL, 3/4 ton - with a damaged throat latch to lift tires weighing up to 400 pounds for installation on tractors [Reference: ASME B30.10-1999, Section 10-1.3, paragraph (i)]. b)assembly area: two employees used a hook that was not load rated to lift tires weighing up to 400 pounds for installation on tractors [Reference: ASME B30.10-1999, Section 10-1.3, paragraph (a)]. Among other means, one feasible and acceptable abatement method to correct these hazards would be to repair the damaged hook throat latch and to replace the hook that was not load rated with one that is load rated for the loads lifted.
