North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazards caused by not training employees in the safe operation of the Model 843 Bobcat and by using a lifting device that was not approved by the manufacturer of the Model 843 Bobcat: a)Custom Stone Masonry, Inc. - the Bobcat Model 843 was operated to move granite and marble, slabs and counter tops, around the facility without a training program in place. b)Custom Stone Masonry, Inc. - the Bobcat Model 843 was operated by employees with a boom lift extension attached to the lifting mechanism which was approximately seven feet long, without the manufacturers approval. Among other methods, one feasible and acceptable abatement method to correct these hazards would be to develop a proper training program for employees who operate the Bobcat and to use lifting equipment approved by the manufacturer. Reference: Model 843 Bobcat Operators Manual. a) Training excerpts from the Model 843 Bobcat Operators Manual: I. - Safety Instructions A. Safety is your responsibility B. Before operating the Bobcat Loader WARNING - Operator must have instructions before operating loader. Failure to obey warnings can cause injury or death. The Operator's Manual was written to give the owner/operator instructions on the safe operation and maintenance of the Bobcat loader. Read and understand this operators manual before operating your Bobcat. (page i) C. Safe Operation needs a Qualified Operator 1. Understand the written instructions, rules and regulations. 2. Have Training with Actual operation a. Operator training must consist of a demonstration and verbal instructions. This training is given by the Bobcat dealer before the loader is delivered. (page 2) b) Lifting capacity excerpts from the Model 843 Bobcat Operators Manual: WARNING - Never use attachments or buckets which are not approved by Melroe Company (Bobcat). Buckets and attachments for safe loads of specified densities are approved for each model of loader. Failure to obey warnings can cause injury or death. (page 12)ge
