North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being caught in rotating parts or ingoing nip points of moving conveyors: Ref: American National Standard Safety Standard for Conveyors and related equipment (ANS) B20.1-1976 5.11.2.3 a)facility - remotely and automatically controlled conveyors, and where operators stations are not manned or are beyond voice and visual contact from drive areas, loading areas, transfer points, and other potentially hazardous locations on the conveyor path not guarded by location, position, or guards, was not furnished with an emergency stop buttons, pull cords, limit switches, or similar emergency stop devices.y
