North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to falls: a)establishment, throughout - where employee(s) working from Raymond, Type E, EASi Order Picker Lift Truck at height up to 30 feet were exposed to fall hazards when they used Miller Equipment 6 to 8 feet tethers and Miller Equipment 8 feet retractable lanyards in lengths greater than 5 feet. Abatement note: One feasible and acceptable abatement method, among others, to correct this hazard is to equipped the Raymond, Type E, EASi Order Picker Lift Truck with 5 feet lanyards and/or with equivalent fall protection. (Reference: American Society of Mechanical Engineers, Safety Standard for Low Lift and High Lift Trucks, ASME B56.1-1993, Section 7.35.1)
