North Carolina General Statute 95-129(1) of the Occupational
Safety and Health Act of North Carolina:  The employer did not
furnish each of his employees conditions of employment and a
place of employment free from recognized hazards that were
causing or likely to cause death or serious physical harm to
employees in that employees were exposed to a struck by hazard:
a)jobsite, Trinity Grove subdivision - where employees
were working on an excavation project around a Komatsu
Dresser Company hydraulic excavator (track hoe), model
no. PC300LC-5LC, s/n A30170, and the area was not
cleared before operation of the track hoe. REF:  PCSA
Standard No. 3, Mobile Hydraulic Excavator Standards;
Owner's Manual for Komatsu Excavator; and Association
of Equipment Manufacturer's (AEM) Hydraulic Excavator
Safety Manual.
AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT
METHODS TO CORRECT THIS HAZARD ARE TO ENSURE THAT NOBODY COMES
INTO THE SWING RADIUS OR TRAVEL PATH OF THE REVOLVING
SUPERSTRUCTURE.  IN ADDITION, BEFORE STARTING TO MOVE, THE
OPERATOR SHOULD SOUND THE HORN OR GIVE A SIGNAL TO WARN EMPLOYEES
NOT TO COME CLOSE TO THE MACHINE.  WHEN FEASIBLE, SET UP SAFETY
BARRIERS TO THE SIDES AND REAR AREA OF THE SWING PATTERN TO
PREVENT ANYONE FROM WALKING INTO THE WORKING AREA.  POSITION A
SIGNALMAN FOR DANGEROUS AREAS OR PLACES WHERE THE VIEW IS
OBSTRUCTED.
