North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to crushed by hazards: a)280 Towerview Court-where on or about 05/26/04 an employee of Citadel Contractors, Inc. providing crane signals for an employee of C.P. Buckner Steel Erection who was operation an Manitowoc lattice boom crane, model 999, serial 1046, was over boomed with an attached and suspended tilt-up panel #33 exerting a lateral load on tilt-up panel #34, which was in place and braced and weighing 92,000 pounds, resulting in the collapse of tilt-up panel #34. [Reference ANSI: B30.5-1968, Section 5-3.1.3(c)]: The operator shall respond to signals only from the appointed signalman, but shall obey a stop signal at any time, no matter who gives it. A feasible means of abatement is to instruct all employees on site in the recognition of over boomed haxards.ion
