Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. Employees were exposed to an injury because they were not restrained in a forklift in case of tipping and/or rollover: a.Continental Airlines Cargo Warehouse, Tiyan, Guam: Two employees were observed not using seatbelts on the forklift they were driving. On the Yale Forklift, model: GDP75HCJ, serial number: FM0002, the seatbelt was inoperable.
